1. These terms

These terms govern your use of the Incorporated Scotland platform. By creating an account or using the service you agree to them. If you are agreeing on behalf of an organisation, you confirm you have authority to bind that organisation.

2. The service

The platform imports publicly available records about incorporated Scottish companies from Companies House, stores them with their provenance, and presents them alongside clearly labelled AI interpretation. It covers incorporated companies only; unincorporated businesses are not registered at Companies House and therefore do not appear.

3. Accounts

You must provide accurate registration details, keep your credentials confidential, and not share access with people outside your subscription. You are responsible for activity carried out under your account. We may suspend accounts where we reasonably suspect misuse or a security risk.

4. Subscriptions and payment

Access is provided on a flat rate subscription basis. Prices are shown up front and there are no usage tokens, credits or AI usage limits. Fees are payable in advance for the subscription period and are non-refundable except where required by law. We will give reasonable notice before any change to fees takes effect.

5. Acceptable use

You must not:

use the platform, or data obtained from it, to send unsolicited marketing in breach of the Privacy and Electronic Communications Regulations or UK GDPR; resell, redistribute or republish bulk extracts of the data as a competing dataset, directory or lead list; scrape or systematically extract data other than through the export features provided; attempt to circumvent authentication, rate limits or access controls; or use the platform for any unlawful, discriminatory or harassing purpose.

Exports are provided so that you can work with data inside your own organisation. They are not a licence to build a rival data product.

6. Companies House data

Register data is public sector information licensed under the Open Government Licence v3.0. You must comply with that licence, including attribution, in any onward use. Where register data contains personal data, you are responsible for your own compliance with data protection law when you use it.

7. AI interpretation

AI interpretation is an interpretation of stored facts, not a verified fact and not professional advice. It may be incomplete or wrong. It must not be relied on for credit, insurance, employment, legal, financial or other decisions about a company or an individual without independent verification against the underlying record. Verified facts and interpretation are always presented separately and interpretation is always labelled.

8. Availability

We aim to keep the service available but do not guarantee uninterrupted access. Imports depend on the availability and rate limits of the Companies House API, and enrichment depends on third party AI infrastructure. We may carry out maintenance and may change or withdraw features as the platform develops.

9. Intellectual property

We own the platform, its interface, its taxonomy and its prompt and interpretation systems. You retain ownership of the content you create within it, such as saved filters and reports, and grant us the licence needed to host and display that content to you.

10. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, we are not liable for loss of profit, loss of business, loss of anticipated savings, or indirect or consequential loss, and our total liability in any twelve month period is limited to the fees you paid in that period.

The service is not a substitute for professional advice or for your own due diligence.

11. Termination

You may cancel at the end of your current subscription period. We may suspend or terminate access for material breach of these terms. On termination your right to use the platform ends and exports must comply with clauses 5 and 6.

12. Changes and governing law

We may update these terms and will change the date shown above when we do. Continued use after a change amounts to acceptance. These terms are governed by the law of Scotland and the Scottish courts have exclusive jurisdiction.
